Other forms of Alternative Dispute Resolution

 

Mediation, adjudication and arbitration are the best known forms of ADR.

However, they may not always be appropriate to the reasons why the parties have not been able to find a solution themselves. As a result, more tailor-made processes may be required. Some of these are set out below.

- Expert determination. Where solely matters of expert opinion or interpretation of the law arises, an expert in the relevant field may be appointed to determine matters.

- Med-arb. As the name suggests, this is a mixture of mediation and arbitration/adjudication. If the mediation fails, the parties can agree that the mediator will adjudicate the dispute.

- Executive Tribunal. A senior executive from each party is appointed to sit with a mediator to try to reach agreement.

- Dispute Resolution Board. In large projects, particularly overseas, a tribunal is set up at the outset to meet and, if necessary, to resolve disputes.
